Acceptance of these terms
By browsing zenithia.lat or approving a quote, you accept these terms. If you disagree with any of them, please don't hire the service and write to us so we can talk it over.
When you hire us, the agreement between you and Zenithia is made up of the quote you approve and these terms. If anything in the quote differs from what is written here, the quote prevails, because it is tailored to your project.
Our services
- Websites and landing pages: custom design for mobile and desktop, with a direct WhatsApp button and basic SEO.
- Digital menus for restaurants and bars: a bilingual menu (Spanish and English) that opens from a QR code, with no app to download.
- Maintenance and updates: changes to text, photos, dishes and prices, and checks that everything works.
Exactly what each project includes (sections, languages, number of dishes, timelines) is detailed in its quote.
Quotes and prices
- Each quote is valid for 15 calendar days from its issue date.
- Prices are stated in Peruvian soles (S/) or US dollars (US$), as indicated in the quote.
- Prices are not subject to IGV (Peruvian VAT). For each payment we issue an electronic fee receipt (recibo por honorarios electrónico).
- Prices published on the website, such as the launch price of the digital menu, are for reference and may change. A price change never affects a quote you have already approved.
- Promotions (for example, “special price for the first 3 restaurants”) apply while spots remain and as stated on the website or in the quote.
Payment
- 50% deposit when you approve the quote. This payment reserves your slot and we start working.
- Remaining 50% when we deliver the finished project, before it is published for good.
- Monthly maintenance is paid on the date stated in the quote.
- We accept bank transfer and, for payments in soles, Yape and Plin. Payment details are listed in each quote; only use the ones shown there and, if in doubt, confirm them on WhatsApp.
Delivery timelines
Timelines are counted in business days (Monday to Friday, excluding public holidays) from when we receive the deposit and the materials we need: logo, text, photos and, for menus, the list of dishes with their prices.
If materials arrive late or incomplete, or if answers to our questions are delayed, the timeline moves back by the same amount of time. We will always let you know what stage your project is at.
Revisions and approval
Each project includes 2 rounds of changes on the preview version we send you. A round is one list of changes sent together, so we can apply them all at once.
- Additional changes, or changes outside the quoted scope (for example, a new section or a redesign), are quoted separately before we make them.
- If 15 calendar days pass after we send a version without receiving feedback, we will consider it approved.
What is not included
Unless the quote says otherwise, projects do not include:
- Buying or renewing your own domain (for example, .com or .pe).
- Professional photography or advanced image editing.
- Writing new copy from scratch (we do organise and polish the text you give us).
- Monthly maintenance, in the case of websites.
- Paid plans for third-party services (advanced hosting, business email, paid apps or integrations).
Your content
You provide the logos, photos, text, prices and other information about your business. By doing so, you confirm that:
- You have the right to use that material and for us to publish it on your website or menu.
- The information is accurate. Prices, dishes, ingredients and allergen information are your business's responsibility; we publish them exactly as you send them.
If we use photos or resources from free stock libraries, we do so in line with their licences.
Ownership of the work
- Once you pay 100% of the project, the final design and the content of your website or menu become yours to use in your business.
- Zenithia keeps the tools, base code and generic components we use across projects; you receive the right to use them within your website or menu with no time limit.
- We may show your project in our portfolio and on social media. If you'd rather we didn't, write to us and we'll take it down.
- Until payment is complete, the delivered work remains Zenithia's property.
Monthly maintenance
The maintenance plan covers changes to text, photos, dishes and prices, simple new sections or dishes, and checks that everything works. Requests are made by WhatsApp or email.
- You can cancel at any time by letting us know before your next payment date.
- If a monthly payment is more than 15 calendar days late, we may pause the service. When the website or menu is hosted on our accounts, we may also take it offline, always with prior notice by WhatsApp or email.
- Major changes (redesigns, new features) are not part of maintenance and are quoted separately.
Third-party services
To publish and run your project we use services from other companies, such as web hosting and domain providers, WhatsApp or Google. Each has its own terms.
We don't control those services, so we are not responsible for their outages or changes in price or features. If something fails on their side, we'll help you resolve it as soon as possible.
Cancelling a project
- If you cancel before we start designing, we refund the full deposit.
- Once work has started, the deposit is non-refundable, because it covers the hours already spent on your project. We will hand over the work done up to that point.
- If Zenithia cannot continue the project for reasons on our side, we will refund the portion corresponding to work not done.
Liability
We work carefully so your website or menu runs well on current browsers and phones, but no site is free of bugs. When we find, or you report, an error in our work, we will fix it at no cost.
We are not liable for indirect losses, such as lost sales or profits. In any case, our maximum liability for a project is limited to the amount you paid for that service.
Nothing in these terms limits the rights that Peruvian law grants to consumers.
Use of this website
- The text, design, logo and the Zenithia name are our property. They may not be copied or used without permission.
- The demo menu (“Lúcuma & Sal”) is a fictional restaurant, created only to show how the service works.
- Portfolio projects belong to their respective owners and are shown for reference.
Changes to these terms
We may update this document when our services or the law change. The date of the last update appears at the top. Projects already hired are governed by the version in force when you approved the quote.
Governing law and complaints
These terms are governed by the laws of the Republic of Peru.
If you have a complaint, please write to us first at hola@zenithia.lat or on WhatsApp. We will always look for a direct solution. If we cannot reach an agreement, any dispute will be settled by the judges and courts of Lima, without prejudice to your rights under consumer protection law.
